The Bombay High Court has suspended Bollywood superstar Salman Khan’s sentence, which also means that he will not have to go to jail. The appeal will continue and Salman will now have to apply for fresh bail, after which he is a free man – for the time being atleast.
However, the Bombay High Court judge made a couple of important points, which could result in revoking the serious ‘culpable homicide’ charge.
High Court judge Abhay Thipsay, while handing out a suspended sentence for Salman Khan said
1. There is no likelihood of Salman Khan absconding, therefore it was proper to suspend his sentence pending appeal.
2. This was the first case where culpable homicide or section 304 (2) was invoked in an accident case
The second point is important, because if the charges of culpable homicide not amounting to murder or section 304 (2) is revoked, he could then be tried under Section 304 A, which is ‘causing death by negligence’, that carries a maximum punishment of two years.
The other point to be noted is, Salman’s conviction has not been overturned. The case will be heard again when a fresh appeal is filed after the court resumes on June 15. The court will then allow Salman to file a fresh appeal in the case which may be heard by July. The case might then take a few months or maybe even years.
For now, it can be safely said that Salman is free till June 15 and he can resume the shooting of his upcoming film ‘Bajrangi Bhaijaan’.
@JS: Loser, when did I say that he had purposefully done it? He was DRUNK and he lost his CONTROL which is why His car ran over the poor people. Shouldn’t there be any punishment for such punishable acts? Who on this earth given you the rights to take one’s life?
If any normal citizen had been in Salman’s place, the case won’t even be considered. It would not be registered and not be under trial like the thousands of hit and run cases in India. The only advantage he’s getting is the ability to hire a prominent lawyer to fight his case.NOTHING ELSE.

@gj007 nothing against your point of view but you are completely wrong this time, Aamir is doing SMJ, he talks very good thing on that show, that about the build up show and the way it works. Salman was a person who supported him when Aamir was in his personal crisis, then how come Aamir won’t give his support to Salman when he had bad time, Aamir didn’t said anything against law but he can’t insult friendship. Regarding Salman being guilty it was from day 1 that he was guilty, Aamir was his friend from long time so basically you shouldn’t watch his earlier films too. For me its most important that Aamir involved in good films what he do in personal life if it good than I appreciate & if not than criticise but I can’t leave supporting Aamir. Regarding hypicricy its a human nature what you preach in society doesn’t mean you are bound to do everything in real life, it can’t happen.in social platform Aamir is most targeted actor due to obvious reason.As an Aamir fan I don’t care, he can produce delhi belly but also has guts to criticise AIB,Aamir is Aamir you can decide you like or not but the guy is full of his own methods.

Its very funny that how the people feel sympathy for a person who died in accident from Salman’s car, people are reacting like someone from their family had passed away.In today’s life when a common man doesn’t care about his relatives life or death no matter what other than his blood relation like brother,sister parents etc (exceptions are there but most of the people) and pretending here that how good they are and how much they feel for country and people. Don’t show off guys face the reality that our juridication system fails just like our emotions getting failed for people around us.
Salman did the wrong thing and he deserve punishment but by commenting against him or showing fake opinions doesn’t change the reality. Any body who was in Salman’s place would do the same what he is doing to save himself, everybody do the same for their loved ones, legal or illigle doesn’t matter.

Im a big salman fan but fact of the matter is that Salman has been a repeat offender – hit n run case, black buck, arms, beating up your gf……he’s a guy who has abused the law all throughout!
Everyone knows Salman was drunk and was indeed driving the car! He has been charged with section 304 because he was well aware that people sleep on pavements where the accident happened. He has misrepresented facts to the court saying he wasnt driving etc etc
it not about salman but about a big influential celebrity getting preferential treatment………where will the law of the country go? yes there have been similar cases in the past where punishment has been less severe but they are no benchmarks…..

first salman’s lawyers drag the case for 13 years and then when they want they get bail in few hours ???????? is our legal system a joke? can we expect this kind of disparity anywhere else in the world?
guys like many i love salman but not at the cost of justice being denied or the systems of this country being abused. People say that he has started Being Human etc…..he still does two films a year, mints money from everywhere…..hes no mother teresa who has dedicated his life to social causes…….

If the verdict given by a sessions court is meant to be final, why do we have high courts and supreme courts? The verdict of sessions can always be challenged . People acting like very intelligent people but won’t give a minute to actually understand the situation.

I am disappointed, but let the law takes it course..however corrupt the system.
Salman has shown absolutely no respect for the law.
He has hunted and killed protected species;
run over sleeping HOMELESS people;
killed a man while in a drunken state
and some of his fans are happy.
However he has lost one…ME.
My punishment for him… 1/ build a comfortable home to accommodate 50 homeless people and provide a trust for its maintenance. 2/ PAY the family of the man he killed at least one core 3 /Do community work for three years and 4/ Join alcoholic anonymous.
Salman Khan will never go to jail, some of his enemies want to bring him down, That will never happen as he has strong fan base.
Salman is now good human. whatever happen happened? He is paying huge income taxes and also giving much charity to needy people. He is completely change person now. He should be let free. I like indian judiciary.
