Some important developments in Salman Khan’s hit-and-run case

The Bombay High Court has suspended Bollywood superstar Salman Khan’s sentence, which also means that he will not have to go to jail. The appeal will continue and Salman will now have to apply for fresh bail, after which he is a free man – for the time being atleast.

However, the Bombay High Court judge made a couple of important points, which could result in revoking the serious ‘culpable homicide’ charge.

High Court judge Abhay Thipsay, while handing out a suspended sentence for Salman Khan said

1. There is no likelihood of Salman Khan absconding, therefore it was proper to suspend his sentence pending appeal.

2. This was the first case where culpable homicide or section 304 (2) was invoked in an accident case

The second point is important, because if the charges of culpable homicide not amounting to murder or section 304 (2) is revoked, he could then be tried under Section 304 A, which is ‘causing death by negligence’, that carries a maximum punishment of two years.

The other point to be noted is, Salman’s conviction has not been overturned. The case will be heard again when a fresh appeal is filed after the court resumes on June 15. The court will then allow Salman to file a fresh appeal in the case which may be heard by July. The case might then take a few months or maybe even years.

For now, it can be safely said that Salman is free till June 15 and he can resume the shooting of his upcoming film ‘Bajrangi Bhaijaan’.

  • Those who are feeling frustrated n disappointed at this decision by the court should BOYCOTT salman’s next film Bajrangi Bhaijaan!!
    One film not watched in theatre won’t cost you much but the hypocrisy that will be on display will!!

    There will be many good films releasing this year,Boycott Bajrangi Bhaijaan at all cost!

Not only just did he commit a crime, but he left those poor people in injurous state that night night. And most importantly, he Manipulated Indian Law for 13 years. Also, the real witness was tortured by his Lawyers and Indian Police and he finally died. “I WAS NOT DRIVING” “I WAS NOT DRUNK” “I TOOK ONLY WATER AT THE BAR” “MY TYRE GOT DAMAGED” and many more excuses he has given. Seriously!
    13 years to convict. 2 hours to Bail. 2 days to suspend a final sentence.
    THIS IS INDIAN JUDICIARY.

    He has hired prominent lawyer Harish Salve…..

    54 year old Harish Salve, former Solicitor General of India, is, arguably, today’s most expensive lawyer in India. He has represented high-profile cases like Mulayam Singh Yadav, Prakash Singh Badal and Lalit Modi but his reputation (and legal fees!) started sky-rocketing after he won Mukesh Ambani’s gas dispute against brother Anil who was represented by Ram Jethmalani. His latest on-going-case is representing Ratan Tata who has gone to the Supreme Court claiming that his privacy has been violated in the Nira Radia tapes scandal.

    Hiring Harish Salve as lawyer does not come cheap. He charges a massive fee of Rs 30 lakhs per day. His fees alone is supposed to have cost Mukesh Ambani a whopping Rs 15 crore. Even this pales into insignificance when you compare it with the Rs 60 crore which he is supposed to have collected in the Forest Case of TN Godavarman Thirumulpad. In addition, he has to be provided overnight five-star suites and first class air-tickets. A dinner for him and his team at a five star hotel can cost over Rs 2 lakh. Clients have been known to present him a hot Vertu phone or a Jaeger-LeCoutre watch to keep him in good mood. Further, Salve will only accept the first brief. In other words, he will never be the second counsel to anyone else in any case. Salve drives a Bentley and has a holiday home in Goa. Fashion-conscious Salve visits London frequently to shop for his clothes. That is when his clients do not get them for him as in the case of Mukesh Ambani who is supposed to have bought an entire wardrobe of clothes for him when fighting his brother!

  • @gj007:: I think you jumped onto the conclusion too early,yes Aamir was there to meet Salman,hugged him but that does’nt necessarily mean that he supports Drunk driving..he might be there to meet his good friend who was in trouble from few days and like any other friend he went there..If he would’nt have gone there,then again a wrong message would have been out that aamir is so selfish n bla bla..

  • @Gj007.. come one man.. don’t take these things so seriously. God forbid, one day if your closest friend or family member drinks, drives and kills someone.. will you completely cut off all ties with them? Won’t you be there to support them during their tough times?

    They are friends first and foremost. No one is questioning the verdict.. but at the same time, they are giving him strength during these tough times.

    We are all humans and no one is perfect. Salman might have done the biggest mistake of his life by drinking and driving… but he has also saved thousands of lives.

    It was a mistake, which he regrets and he’s a changed man now. We should learn to forgive and forget.

    IMO rash driving and killing innocents on the streets by bus and lorry drivers is a crime too. That’s considered to be accident, but remember these people drive above speed limit in complete consciousness..

    Accidents happen. There is absolutely nothing that we can do. In my very honest opinion, Salman has suffered enough and more in the last 13 years. Put yourself in his shoes and you’ll know!

    I am amazed at your “dont take it seriously” attitute. To answer your question, this was NOT an accident. When you “drink” and drive, you’re committing a murder.

    The most ironic thing is, the words i have typed are extracted from “Holy Saint”, Shri Aamir Khan’s SMJ! That episode is on youtube.

    check out the entire episode, where our so called gyaany baba is preaching how drunk driving is equal to murder. And there is a case shown where the family of the accused is shown in extremely bad light.

    You know what, i respect people like Hrithik who maintain complete silence or people like srk who are unabashedly clear of their actions and intentions, whether good, bad or ugly. Aamir khan comes of as an incredibly pretentious man who does exactly the reverse of what he preaches.

    I will happily watch smj 4 for the effrts of his team, but this man appears to be full of double standards!

    Salman may be an incredible philanthrophist. he may have saved many lives, but that doesnt in any way justify him escaping so lightly.

    If it was Abdul khan instead of Salman khan will you say the same thing to me? About me abandoning someone, I dare freaking say, i would support my friend/brother till provrn guilty,but if i figure out he was actually responible for ruining life of a family i’d most certainly abandon him

    The whole drama is because he is the most popular superstar at the moment. And paying the victims’ kin is not how indian judiciary works.

It took 13 years for a verdict , 2 hours for a bail and just 2 days for suspending such a final sentence! ! Bhaitards always bark about manipulation in K3! But they cann’t how the judiciary is being manipulated by their Bhai’s money power. I really felt bad when I came to know about dead eye-witness.
    Salman mightn’t have done it intentionally. Bt it was a result of his Carelessness. Who on this planet has allowed you to run your car over poor people in “alcoholic state”? And Who the bloody hell are u to call me a beggar? Beggars are those who are showing their blind and biased support,.

Man, if it’s the case, then all the rich criminals on this planet will be left free and given a chance to change themselves and to do charity for under-priviledged people.     Salman maybe guilty of drinking, but you are saying he purposefully drove the car over those people? Is that what you are saying?
    You fool need to understand, even the High Court has classified this case as
    Section 3.4(a) ‘Death due to Negligence’
    Its not murder, its an accidental death case.

  • My faith in the Indian Judiciary System I grew up with has now been fully restored…!

    An accident even if its negligent still shouldnt be treated as a crime where intent needs to be proved.

    I dont care what chameleon gauravs or nipoons say but this is the Indian Justice at its best. We all inspire to be rich n powerful so we shoukd enjoy afew benefits privileges along the way otherwise whats the point of being rich n powerful if you get treated like a common thug…..
