Urging the media to get their ‘facts right’ with regards to his 2002 hit and run case, Salman Khan has launched a website (salmankhanfiles.com) to put the facts out in the public domain. The website contains all information pertaining to the case.

Accident Case Update: June 24, 2013

Criminal Revision Application No. 220 of 2013 was listed for orders before His Honour Judge Mr. U. B. Hejib. The Hon’ble Judge has dictated a detailed order, and at the end of the dictation has said he is dismissing the Criminal Revision Application. The Hon’ble Judge has further said that the case committed by the Hon’ble Magistrate to the Hon’ble Sessions Court will be listed on July 19, 2013 for “Framing of Charges”.

Upon the order being made available, we will assess next steps, including challenging the same before the Hon’ble Bombay High Court.  It would not be appropriate to comment on the order, or next steps, at this stage.

Accident Case Update: June 10, 2013

June 10, 2013 : Criminal Revision Application No. 220 of 2013 was listed for orders before His Honour Judge Mr. U. B. Hejib. The Hon’ble Court was pleased to adjourn the case to June 24, 2013 as Court staff were unable to attend today due to excessive rains.

Accident Case Update: May 08, 2013

Criminal Revision Application No. 220 of 2013 along with Sessions Case No. 240 of 2013 were listed for hearing before His Honour Judge Mr. U. B. Hejib. Parties filed their written submissions in the Revision Application. Ms. Abha Singh filed written submissions on behalf of Mr. Santosh Daundkar for intervening in the Sessions Case 240 of 2013.

The advocates for the parties first argued the intervention application of Mr. Daundkar. Ms Abha Singh then clarified that she was not pressing the intervention application to intervene in the Revision Application.

Thereafter, the parties made their respective submissions in the Revision Application. Arguments were concluded and the Hon’ble Judge has kept the Revision Application for orders on June 10, 2013.

Accident Case

I. C.C. NO. 490/PS of 2005 before the Hon’ble Additional Chief Metropolitan Magistrate, 9th Court at Bandra, Mumbai

January 31, 2013 – The Hon’ble Additional Chief Metropolitan Magistrate, 9th Court at Bandra, Mumbai, held that the offence under Section 304 Part II of the Indian Penal Code, 1860 is applicable, and is exclusively triable by the Hon’ble Court of Sessions. Hence, the criminal case was committed to the Hon’ble Sessions Court of Greater Bombay for framing of additional charge under Section 304 Part II of the Indian Penal Code, 1860.

II. Criminal Revision Application No. 220 of 2013 before the Hon’ble Court of Sessions for Greater Bombay

  • March 5, 2013 – Criminal Revision Application No. 220 of 2013 filed by me before the Hon’ble Court of Sessions for Greater Bombay under Section 397 of the Code of Criminal Procedure, 1973, for quashing and setting aside the order dated January 31, 2013, passed by the Hon’ble Additional Chief Metropolitan Magistrate, 9th Court at Bandra, Mumbai.
  • March 6 and 8, 2013 – Criminal Revision Application No. 220 of 2013 was heard by the Hon’ble Sessions Court at Greater Bombay, Court Room No. 23 presided over by His Honour Judge Mr. A.N. Patil. In view of the common issues that were involved in the Criminal Revision Application No. 220 of 2013 and Sessions Case No. 240 of 2013 (i.e., the case that was committed to the Hon’ble Sessions Court by the Hon’ble Additional Chief Metropolitan Magistrate, 9th Court at Bandra, Mumbai), the advocates appearing for me suggested to the Hon’ble Court that without prejudice to my rights and contentions, an application can be made to the Hon’ble Principal Judge of the Sessions Court for assigning both the Criminal Revision Application No. 220 of 2013 as well as the Sessions Case No. 240 of 2013 before the same Hon’ble Judge. The suggestion was accepted by the Hon’ble Judge and he directed me to file an application accordingly on the same day. The Application was filed before His Honour Judge Mr. A. N. Patil at 3 p.m. upon which the Hon’ble Judge, by his order dated March 8, 2013, directed the Registrar (Sessions) to place the Criminal Revision Application No. 220 of 2013 before the Hon’ble Principal Judge of the Sessions Court for appropriate orders for assigning both the Criminal Revision Application No. 220 of 2013 as well as the Sessions Case No. 240 of 2013 to the appropriate Hon’ble Judge.

III. Case No. 240 of 2013 before the Hon’ble Court of Sessions for Greater Bombay

  • March 25, 2013 – Sessions Case No. 240 of 2013 as well as Criminal Revision Application No. 220 of 2013 were listed before His Honor Judge U. B. Hejib presiding in Court Room No. 25. As on this date, I had not received notice of the hearing from the Hon’ble Court. However, my advocates filed their vakalatnama in the matter. The Hon’ble Judge indicated that he will hear the Criminal Revision Application No. 220 of 2013 filed by me, and accordingly the matter was adjourned to April 8, 2013.
  • April 8, 2013 – Sessions Case No. 240 of 2013 along with Criminal Revision Application No. 220 of 2013 were listed before His Honor Judge Mr. U. B. Hejib presiding in Court Room No. 25. However, since the Hon’ble Judge was not presiding, both Sessions Case No. 240 of 2013 and the Criminal Revision Application No. 220 of 2013 were adjourned to April 29, 2013.
  • April 29, 2013 – Sessions Case No. 240 of 2013 and Criminal Revision Application No. 220 of 2013 were listed before His Honor Judge Mr. U. B. Hejib presiding in Court Room No. 25. Upon a query raised by His Honour Judge, my advocates indicated that they would like to argue the Criminal Revision Application No. 220 of 2013 first. Accordingly, His Honour Judge directed my advocates to file written arguments in the Criminal Revision Application No. 220 of 2013 on the next date of hearing i.e. May 8, 2013, after which brief oral submissions could be advanced. Accordingly, His Honour Judge has listed the Criminal Revision Application No. 220 of 2013 for hearing on May 8, 2013.

    To me you are innocent and in the right. You’re simply being persecuted by certain ‘factions’ of the establishment in an opportunistic attempt to grab some cheap headlines and to ‘milk’ more monies out of the system. Its shameful how much money has been squandered here on trying to turn an ‘accident’ into ‘homicide’ when that money could be better used for improvements on roads, traffic control, lighting, cameras etc etc.
    As for convincing the ‘doubters’… let barking dogs bark…!

  • first the drama of charity and now this website…..hehehe…sallu is trying each possible way to get rid of these cases….but it’s difficult for him to deviate indian justice….yes..his cases r taking long time as a usual indian justice…but he ll get punished sooner or later….it’s is almost certain…sanjay dutt is best example for it….sanju had tried a lot to escape away frm the justice but at last he surrendered….

  • @navin….u shud introspect ur words…wat u r saying….certainly, an accident is a usual event…and one shud not charge with an attempt to murder case…but if u r driving while drunk..even in that condition, when u have warned that it might be dangerous for the surroundings….still u r driving…then it will be counted as an offence…and if some one suffers bcoz of him , then he has proper rights to get justice….but stubborn salman did it just for his fun ignorant of the fact that due to his cheap act, a life ended up for forever…

  • it was an accident to start with…. it was not intentional…. accidents do happen and are very unfortunate…. just think had any of your dear ones like your father, mother were involved in an accident and somebody unfortunately died would you still say hang them to death and stuffs like that…. my point is it was just an accident and it can happen to anybody, you me or somebody else…. i sympathize with the victim and their family…. but why were they sleeping on the pavement of the streets??? more than anybody i think the government is responsible for it and it is them who need to be punished who leave the poor to sleep on the streets…. my sympathies are with the victims and as well as salman khan…. none is at fault…. as i said it was an unfortunate accident….

  • its very easy for people to label salman khan as a criminal. the day they will meet with an accident they will truly realize what does an accident mean. yes i am a salman khan fan, yes he should be punished for whatever wrong he did, but charges of culpable homicide is way too much. but this is the price he has to pay for being a superstar. had any one of us been involved in such an accident the police n court would not have even bothered. lets face it how many accidents do u people come across in newspapers daily? plenty, am i right? do you even hear about it the next day? no. but when salman khan does it makes headlines news even after 11years n people give their judgements without even knowing anything n easily label him as a criminal n the judiciary becomes harsher n charge him with more serious charges without any reason. some people here are also saying that he opened his NGO being human to hide his crimes. even if we assume he did, at the end of the day he did manage to save thousands of lives n help thousands of people. what’s wrong in it?

  • I’ll tell you one thing that even if God came down from heaven; even then people would try finding faults in Him. Second, Salman is a friend of friends and the worst nightmare for his enemies. He is not a fake person. Before the media, he is not like ‘Oh I have to put my best face forward’. He behaves the way he is. Other people behave well before the media even when they are angry inside. Salman is real. And that is how a human being should be.

  • Salman is the undisputed king of not just the Box Office, but of social media too. The ‘Dabangg’ superstar, who rules the roost is omnipresent and a brand in himself. His name alone is worth a million bucks. He makes a million hearts skip a beat and his fans would be ever ready to swear by his name. Such is his aura…..we are with u.

  • I think in this modern fast life, everyone wants to take a break from daily run for bread and butter. Everyone wants to take rest, relax and get entertainment. Salman’s movies are giving this entertainment to larger mass and this in return is paying him off. According to me this, one of the main reason for giving consistently hits after hits in recent time. His charity work through Being Human has benefited many and touched many hearts. I sincerely hope he gets more success in life and continues to help poor and needy people of our country.

  • @xzone: may be it is a publicity or way of evading law for you. But it still needs some guts to show transparency about his cases. Ask your srk to learn something from Salman.

  • Now the media can’t write whatever they like to grab headlines, as all is in black and white on the site for the public.

    Also it was his family that initiated this idea, and looks a good thought out one.

    Media can now chase some fading stars ready to be in news for any weird reasons.

  • Folks: We would be wise if we did not comment on this case because we did not witness the accident and we do not know what really happened. All that we are hearing about this case come from the Media and most times they are incorrect. Some people have their own agendas and would like to see the back of Salman Khan; he is too great and too successful. I do not like to comment on hearsay, so I will bridle my tongue until the very end of the court trial and only then will I give my comments.

  • @xzone: do you know how many road accident happen in India each day? and how many of them get punished? I agree the court is doing its work but what about the other 10000 millions cases do all the people get justice? Since Salman is superstar everyone to get name and fame are behind him. A few days back he had given 10-crores for cancer patients, nothing will change if he will go to jail but many things will remain same moreover even he is found guilty they will take the issue to higher court and again to supreme court and for all this process it will take 15-20 years so just chill all Salman haters.

    i think this is serious case than sanjay dutts.

    Dutt had links with mafia but there is no proof for that. without solid proof court cant do anything. But in this case one person died in accident, when Salman was driving.
    police found some weapons in sanjays house without licence.thats not a big deal in todays time. because everyone uses weapons. sanjay has to spend 4years in jail ,because of illegal weapons.
    salmans case is almost equal to murder,atleast salman has to face 10years jail term.black buck case is also there.in these two cases police has solid proofs against him.

  • okay accidents happen, but what would you call when someone despite repeated warnings from his personal police bodyguard consume alcohol more than allowed quantity and then drive car rashly over poor people sleeping on pavements. those people don’t have a roof on them. they live where ever they get place. for driving, road is there. you can’t drive on footpaths,inside malls,inside parks. if this accident would have happened without salman being highly drunk then i may have supported him but sorry, he clearly didn’t listen anybody and did his own, drove car being highly drunk. i can’t support such acts. salman fans, you all are getting over emotional.

  • Mr. Pavan is an eye witness and thats the solid proof in this case. I wish his parents had atleast educated him enough to know the difference between an accident and a murder.

  • the thing i find funny is that the police claims he was driving at 100km/hr and still none of the person sitting in the vehicle got a single scratch, forget serious injuries. from what i can see i think the police and the court has made the accident look far more ugly than it actually was. salman khan is being victimized big time. yes a person was killed and its very unfortunate but it was just an accident. but some morons are adamant to make it look like a murder.

  • salman khan deserves to be behind bars. not only for this case also for the case of killing dear in jodhpur. a guy is killing both people and animals . he would go to jail for sure one day. this is not just an accident if he was just driving and met and accident that was a different thing but here in this case salman khan was heavily drunk as proved in blood test . his bodygaurd told him not to speed up and it owuld lead to some accidnet but he didn’t listen. the court are right in charging him for culpible homicide. justice would prevail one day and he would go behind bars. i think we all shoudl donate a bit to the ngo which is working hard to get justice for the victims. and to the stupid fans- salamn is just an actor who act. the oncscreen dhisum dhisum done by body doubles doen’t make anybody hero but only an actor. real heros are out there in uttarakhand saving lives and not killing people by drunk and rash driving .

  • @aki…yup .. i am aware of all the road accidents in india…but there is a difference….90 percent of road accidents happen due to human mistakes……so u can’t call those drivers guilty..even if sallu wud have done it by mistake , then there was no reason for such charges against him…. but in this case, he was aware of all the things…even he was warned by his bodyguards , that he might be suffer , if he ll drive with such less senses , then he might be suffer…but in the arrogance of his stardom, he din’t listen anyone and drove away with his car resulting crushing those poor beggars….now, according to law, it is a pure murder and he shud be given the same imprisonment, which a normal citizen will be given against such charges…….

Ok dear, we all know that srk is a heavy drinker and a chain smoker, so let us imagine that 2 or 3 days before the release of ce, SRK gets heavily drunk and inspite of warnings and advices from his bodyguards and knowing all the laws, he drunk drives and rams his car into a bakery and kills some 5 or 7 people, because of which his ce gets stopped from screening and then gets a 25 year jail term. Then Will you still say the same things that you are saying now? No you will never, atleast not from your heart.

    I have already told earlier that unfortunately & unintentionally salman is responsible for a death and that incident has changed his life on a whole, ‘being human’ has helped and saved some thousands of lives who were in real need of help, he has never said no to anyone who has asked for any kind of help (unless he is his enemy). I hate people who foolishly say that his charity is just for publicity, when a person can use his immense popularity for a charitable cause and do it whole heartedly and genuinely, then what’s the problem?
