Salman Khan in trouble, charged with culpable homicide

A Mumbai sessions court on Wednesday ruled that Bollywood superstar Salman Khan would be tried under the stringent charge of culpable homicide, not amounting to murder, in the 2002 hit and run case.

The court said the actor will now be tried under Section 304 (III) of the Indian Penal Code (IPC). If found guilty, Khan could face 10 years in prison.

However, the matter has now been postponed to August 16th.

Earlier, Salman had been tried by a metropolitan magistrate under the less severe Section 304A of the IPC relating to rash and negligent driving, which stipulates a maximum of two years in prison.

However, the metropolitan magistrate, after examining 17 witnesses in the case, had invoked the more serious charge under Section 304 (III) of the IPC against the actor. Salman had challenged this order in the sessions court.

One person was killed and four others were injured when a Land Cruiser allegedly driven by Salman in an inebriated state ran over a group of footpath dwellers in Mumbai’s Bandra suburb in the early hours of Sep 28, 2002.

Talking to the media, Salman’s father Salim Khan said “The matter is sub-judice but the verdict will not affect anything.”

  • More precious time and invaluable monies to be wasted in trying to prove an accident was anything more ‘sinister’…! Surely judges and lawyers know where theres serious money to be had then just like vultures they will suck on dry bones and bleed dry this case for every last dime before the correct decision is reached. Bhai jaan is innocent but the establishment just want to drag out this matter for all its worth…! No morality in the system these days just ‘greedy souls’ hungry for more $$$$$…!

  • 10 Years No Way Judges should show some mercy

    In my Point of View people should be punished until they didnt realise
    Should be forgiven if they realise

    But Salman realised and a much more changed man(burried his past behaviour) by doing charity these days so Magistrate should think twice before giving judgement

    Instead of punishment they can write a writ or notice that he should bear those family members in terms of responsibility

    Poor Salman Should gets justice shouldnt be prisoned as his career is in peaks

  • After 10 years session court fixed charges on Salman & now actual case begins.
    5 more years it stand in session court then minimum 5 years in High & 5 years in Supreme Court.

    Means in next 15 years the final result will came.

    Don’t forget Sanjay Dutt’s case verdict was given after 20 years.

  • Same age-old news..just get on with it already, hang the bstard. It seems lawyers are trying to loot as much money as possible from him, before kicking him to the jail..it’s inevitable for him to go to jail, that much is certain but the time is not!

  • salman khan did not had the intention to kill to somebody then how could the charges of culpable homicide be charged against him. i did not see the nation bleed in other accident cases, and here they are commenting on salman’s accident case. do you even know what does an accident means? i would like to see you people comment when your dad commits an accident. would you still say hang him to death. and as far as the law is concerned these charges of culpable homicide does not stand a chance in higher courts.

  • @Joya: go to read the TOI interview with family of one person who died what they are asking about the money only they said they are not against salman but they need money which court orderd already and people got the money who injured but we are not getting it due to id proof Rasan card etc.
    most of all how many people daily died in india through raod accident and how many of them got justice? Media and some greedy people behind for name/fame and money nothing else thing twice before you write.

  • 299 IPC. Culpable homicide.– Whoever causes death by doing an act with the intention of causing death, or with the intention of causing such bodily injury as is likely to cause death, or with the knowledge that he is likely by such act to cause death, commits the offence of culpable homicide. Based on the above definition every person sleeping on a pavement in Mumbai should be booked for culpable homicide ! The very act of sleeping on a pavement is likely to cause you own death or bodily harm due to an accident on the road where the vehicle rolls over on the pavement. I think this judgement of culpable homicide in case of Salman Khan is ridiculous to the extreme. were not the people sleeping on the pavements responsible for their own death? every citizen in india and all over world at some point have been drunk and driving, then everybody should be framed with culpable homicide!

  • Salman Khan fans are beyond ignorant! Driving while intoxicated is against the law – period! He was told not to drive that night because he was very drunk but he did it anyway – period! He killed someone while he was breaking the law by driving drunk- period! He left the scene of the crime for 8 hrs – period! This is not an accident! This was negligence & reckless driving which caused a death. And people have the nerve to blame the homeless man on the sidewalk? Excuse me but since when do people drive on sidewalks? I don’t know what’s more pathetic, the judicial system or the idiots who worship him like a God and blame the victim because they want to see more brainless Salman movies. This is why India is not progressing.

  • it was just an accident and with any one it can happen,suppose if someone going on vehicle and if if accident happpens on turning the bike if if some one dies with our vehicle that does’nt meant that u r the killer it just happpend and the dead man destiny.that time u will only think to get out of this mess.an then i think u peoples doesnt think in this way.

  • we all make mistakes,we can’t control over our destiny. . .we all know it was salman’s mistake after all he was the one driving it. . .it was an accident not a murder. . .but look at him now,he’s a complete changed man now. .he realised his mistakes and i think he should get a second chance 8least. .
